These General Terms and Conditions (“GTC”) apply to purchases made through the online store operated by Velmora Noir.

The webshop sells physical products to consumers.

 

Product Information

The webshop offers handcrafted, premium-quality physical products.

Product descriptions, dimensions, colors, materials and other material characteristics are presented as accurately as reasonably possible.

Minor variations may occur due to screen and display settings, lighting conditions and the handmade nature of the products. Such variations, where they do not affect the essential characteristics of the product, do not in themselves constitute a defect or lack of conformity.

The actual characteristics of each product are determined by the information provided on the relevant product page.

 

Ordering Process and Conclusion of the Contract

Purchases are made electronically through the webshop.

The main ordering steps are:

1.Select the desired product.

2 Add the product to the shopping cart.

3.Enter shipping and billing information.

4.Select the available payment and shipping method.

5.Review the order details.

6.Review and accept the GTC and Privacy Policy.

7.Place the order and, depending on the selected payment method, complete the payment.

Before submitting the order, the customer may review and correct the information provided.

After submitting an order, the customer will receive an electronic confirmation that the order has been received.

The contract between the parties is concluded when the Service Provider electronically confirms or accepts the order.

The contract is concluded in Hungarian or English, depending on the language of the webshop used by the customer.

The Service Provider stores the concluded contract electronically in accordance with applicable law.

 

Prices and Payment Methods

Product prices are displayed in HUF or EUR, depending on the applicable shopping environment.

Prices are determined in accordance with the Service Provider's applicable tax status. The total amount payable and any applicable shipping costs are clearly displayed before the order is finalized.

The following payment methods may be available, depending on the payment options offered at checkout:

• Credit or debit card (Visa, Mastercard, Maestro, American Express, UnionPay)

• PayPal

• Barion

• Apple Pay

• Google Pay

• Shop Pay

• Other payment methods currently offered at checkout

Payment transactions are processed by third-party payment service providers. The webshop does not store the customer's full bank card details.

The order will be processed only after payment has been successfully completed according to the selected payment method, unless otherwise stated by the Service Provider.

 

Shipping and Delivery

The Service Provider ships the ordered products to the shipping address provided by the customer during checkout.

The currently available shipping methods, destinations, shipping fees and estimated delivery times are displayed during the checkout process.

As general guidance:

• Delivery within Hungary typically takes 2–5 business days.

• Delivery within EU Member States typically takes 5–10 business days.

• Delivery to other international destinations depends on the destination country.

Unless otherwise stated on the relevant product page, the preparation or production time of an item may be up to 5 business days.

Once the order has been dispatched, the customer will receive an email notification and, where available, tracking information.

The Service Provider is not responsible for delays caused by courier services or customs authorities that are outside the Service Provider's control, but will take reasonable steps to assist in resolving such issues.

Right of Withdrawal and Returns

Consumers have a statutory 14-day right of withdrawal without giving any reason in relation to qualifying online purchases, subject to the applicable legal conditions.

For contracts for the sale of goods, the withdrawal period is 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods.

To exercise the right of withdrawal, the customer must provide an unequivocal statement of their decision to withdraw, for example by contacting info@velmoranoir.com.

After notifying the Service Provider of withdrawal, the customer must return the goods without undue delay and, in any event, no later than 14 days after communicating the withdrawal.

The cost of return shipping and the conditions of the complimentary return service offered by Velmora Noir are governed by the separate Returns and Refund Policy.

Where required by law, the Service Provider will reimburse the payments received from the customer, including the cost of the least expensive standard delivery option offered. Any additional cost resulting from the customer's choice of a more expensive delivery method is not necessarily refundable.

The Service Provider will make the reimbursement no later than 14 days after being informed of the withdrawal, but may withhold the reimbursement until the goods have been returned or the customer has provided evidence that the goods have been sent back.

Statutory exceptions to the right of withdrawal may apply, including certain goods made to the consumer's specifications or clearly personalized goods.

Further details regarding withdrawal and returns are set out in the separate Returns and Refund Policy. The statutory 14-day withdrawal right is governed by Hungarian Government Decree 45/2014 (II. 26.). 

Statutory Warranty, Conformity and Guarantee Rights

Consumers may have statutory rights in cases of lack of conformity under applicable Hungarian law.

Depending on the circumstances and applicable law, consumers may be entitled to request repair or replacement and, where legally applicable, a price reduction or termination of the contract.

Consumers may also have product liability and statutory guarantee rights where the relevant legal conditions are met.

A statutory guarantee applies only to products and circumstances covered by mandatory legislation or by an additional voluntary guarantee provided by the Service Provider.

All rights relating to defective or non-conforming products shall be applied in accordance with applicable Hungarian law. Nothing in these GTC limits statutory consumer rights. 

If a product is defective or damaged, customers are requested to contact info@velmoranoir.com and, where possible, provide their order number and photographs documenting the issue.

 

Complaints and Customer Service

Customers may submit complaints or concerns by email to info@velmoranoir.com.

The Service Provider will investigate and handle complaints in accordance with applicable law.

Written consumer complaints will be answered in writing on the merits within the statutory time limit, which is generally 30 days. If a complaint is rejected, the Service Provider will provide reasons for the rejection. 

If a consumer dispute cannot be resolved directly between the consumer and the Service Provider, the consumer may contact the competent Hungarian conciliation board based on the consumer's place of residence or domicile.

The consumer may also contact the competent consumer protection authority.

Nothing in these GTC limits any statutory rights available to consumers concerning complaints or consumer disputes.

 

Invoicing

The Service Provider issues an invoice for each purchase in accordance with applicable law.

Electronic invoices may be sent to the email address provided by the customer.

Providing the information necessary for invoicing may be required in order for the Service Provider to comply with its legal obligations.

 

Copyright and Intellectual Property

All content created or used by Velmora Noir and protected by copyright or other intellectual property rights, including product photographs, graphics, texts, logos, product descriptions, designs and other creative materials, is protected under applicable law.

Unauthorized copying, reproduction, distribution, commercial use or other unauthorized use is prohibited.

Purchasing a product does not grant the customer any right to commercially exploit Velmora Noir's intellectual property.

 

Promotions, Discounts and Special Offers

Individual promotions and discounts are subject to the specific terms stated for the relevant promotion.

Unless otherwise stated:

• discounts cannot be applied retroactively to completed orders;

• discounts are non-transferable;

• discounts are valid only during the specified validity period;

• discounts cannot be combined with other promotions where the relevant promotional terms exclude such combination.

The terms of each promotion will be clearly stated in connection with the relevant offer.

The Service Provider may not unilaterally change the price of an order that has already been validly concluded and completed.

 

Limitation of Liability

The Service Provider makes reasonable efforts to ensure that information and product descriptions published on the webshop are accurate and up to date.

Minor differences in color, texture or finish resulting from the handmade nature of a product do not in themselves constitute a lack of conformity where the product corresponds to the essential characteristics stated in the contract and product description.

The Service Provider is not liable for delays or damage caused solely by circumstances outside its reasonable control, such as delays caused by a courier service.

However, the Service Provider does not exclude or limit any statutory rights of consumers.

The Service Provider is not responsible for damage resulting from improper use, improper care or ordinary wear and tear where such damage does not constitute a lack of conformity.

 

Data Protection

Customer personal data is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

Personal data may be processed for purposes including order fulfilment, invoicing, delivery, customer service and compliance with legal obligations.

The Service Provider does not sell or rent personal data to unauthorized third parties.

Amendments to the GTC

The Service Provider may amend these GTC from time to time.

The amended GTC will be published on the webshop together with the date of the amendment.

Amendments apply to orders placed after publication and do not retroactively affect contracts that have already been concluded, unless otherwise required by law or the amendment is more favorable to the consumer.

 

Applicable Law and Consumer Disputes

These GTC and the contractual relationship between the Service Provider and the customer are governed by Hungarian law, subject to mandatory consumer protection and European Union law.

Mandatory consumer protection provisions applicable to the consumer's place of residence and statutory consumer rights may not be excluded or restricted by these GTC.

In the event of a consumer dispute, the consumer may use the conciliation board, consumer protection and court remedies available under applicable law.

 

Acceptance of the GTC

By completing an order, the customer confirms that they have read and accepted these General Terms and Conditions.

Acceptance of these GTC does not affect or restrict any mandatory statutory rights available to consumers.
